New York Anesthesia Malpractice Lawsuit Verdicts & Settlements

Here are examples of the lawsuits we have brought on behalf of patients and their families for anesthesia errors causing personal injury and death:

$8 Million Dollar Settlement for failing to perform a pre-anesthesia assessment

This mandatory evaluation gauges potential difficulties and a plan for safe anesthesia
administration must be made. Our overweight client was being prepared for shoulder
surgery in an outpatient surgical care center. If a proper examination of his jaw and
airway was performed, his anesthesiologist would have understood the expected
difficulties and had been prepared. The patient was deprived of oxygen which caused
his death.

Our malpractice attorneys obtained our client’s medical and hospital records from past
hospitalizations which documented airway difficulties and the proper way of addressing
his condition. A comparison of past pre-surgical anesthesia evaluations demonstrated
he did not receive a proper pre-anesthesia assessment.

$5 Million Dollar Settlement for Improper Anesthesia Medication

Our careful review of the anesthesia record proved improper dosages of anesthetic
agents were administered causing our client’s cardiac arrest and death. Medical
literature obtained from the pharmaceutical companies about proper dosages, review of
pertinent medical literature and the patient’s medical record established she received an
overdose of medication.

$8 Million Dollar Result for failing to monitor the respiratory status of a patient leading to
death

The anesthesiologist failed to properly monitor the patient’s oxygen and carbon
dioxide levels during anesthesia administration which cause our client’s cardiac arrest
and death. The patient’s anesthesia chart lacked critical oxygen and carbon dioxide
levels which we proved was due to improper monitoring.

$6 Million Dollar settlement for improperly placing an endotracheal tube leading to lack of oxygen and death

The proper placement of an endotracheal tube to create an airway for a patient is critical. It is well known if the tube is improperly placed, vital oxygen will not be delivered to the patient’s lungs. The anesthesiologist must assess the proper location of the tube before beginning the administration of anesthetic agents.

Our medical malpractice attorneys obtained the patient’s autopsy results which showed
the tube was improperly positioned in the patient’s stomach rather than lungs, leading to
respiratory failure causing a cardiac arrest and death.

$9.5 Million Dollars for leaving a patient in the hands of untrained residents

Careful questioning of all present in the operating room demonstrated the anesthesiologist was
supervising more than one procedure simultaneously. He left the care of his patient to
inexperienced residents. This was revealed by reviewing the hospital’s operating room
logs which showed the anesthesiologist was simultaneously providing care in two
rooms. When an emergency took place, these untrained residents could not properly
respond leading to the patient’s death.

$9 Million Dollar settlement for patient’s death when an unskilled anesthesiologist could not perform an emergency tracheotomy to provide essential oxygen to a patient leading
to death

Our client’s airway mask became disconnected during surgery when the patient’s position was changed on the operating table. The anesthesiologist failed to take emergency measures to re-establish an airway and he could not reapply the mask.

The anesthesiologist lacked the skills to perform an emergency tracheotomy and during
this precious our client was deprived of oxygen. Depositions of other anesthesiologists
called to assist established the negligence of the responsible anesthesiologist.
