Case Overview 

The injured worker was performing overhead work at a commercial construction project on an unsecured ladder.  The ladder he was using suddenly shifted, causing him to fall from a significant height. He sustained multiple leg fractures requiring surgery.

These laws were used by our law firm to establish an unsafe construction worksite, unsafe conditions, unsafe assistance, and unsafe equipment provided to our client.   

Through a meticulous investigation including obtaining witness reports, accident investigation reports, New York City Building Department inspection records, and interviews with key employees, our construction accident attorneys proved the ladder was not well maintained and was not being secured when our client was performing his work.  While working overhead, the ladder suddenly moved causing him to lose his balance and fall to the ground.   

Our attorneys skilled in construction accident law and protections required to be given to construction workers showed violations of key provisions of the New York State Labor Law and the New York State Industrial Code.  

We showed the general contractor and owner of the work site did not provide adequate fall protection including stable and properly secured ladders in violation of New York Labor Law § 240(1). 

We further proved violation of  violations of New York Labor Law § 241(6) because the site owner and general contractor violated safety standards for safe ladders in the New York State Industrial Code.  

Our client did not receive a safe place to work as required by New York Labor Law §200.

We also offered the testimony of an orthopedic surgeon, aided by medical illustrations of the fractures our client sustained and the surgical repair which was required.  Our medical expert explained and highlighted to the jury the long-term impact the injuries would have on our client’s ability to return to work.   

Settlement Outcome
